Terms of Service

These Terms of Service ("Terms") govern your use of greatoakmedical.com (the "Site") and your purchases from Great Oak Medical. Great Oak Medical is operated by Pragmatic Projects, Inc., doing business as Great Oak Medical ("Great Oak Medical", "we", "us"). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Who we are and what we sell

Great Oak Medical is an online retailer of medical supplies and equipment. Many products are shipped directly by the manufacturer or an authorized distributor. Product names, brands and logos on the Site belong to their respective owners, and their appearance does not mean the owner endorses us.

2. Using the Site

  • You must be at least 18 years old, or use the Site with the involvement of a parent or guardian.
  • Give us accurate information when you create an account, request a quote or place an order, and keep your account sign-in details private. You are responsible for activity under your account.
  • Do not use the Site to break the law, to interfere with it or its security, or to copy pricing, product data or content with automated tools (scraping, bots or similar) without our written permission. We may block access that we believe is automated or abusive.

3. Not medical advice

Information on the Site, including product descriptions, blog articles, videos, and answers from our AI shopping assistant, is for general information only. It is not a substitute for professional medical advice, diagnosis or treatment. Always ask your doctor or other qualified healthcare provider about a medical condition or about which product is right for you. In an emergency, call 911. Our AI assistant can make mistakes; please check important details on the product page and with a healthcare professional. Please do not share medical records or personal health information with us through the Site, the assistant or social media.

4. Products, prices and availability

  • We work to keep product information, pricing and stock status accurate, but errors can occur. We may correct an error, including a pricing error, and cancel or adjust an affected order. If we do, we will contact you, and if you have already paid for an order we cancel, you will be refunded in full.
  • Prices are in U.S. dollars and can change without notice. The price that applies is the price shown when you place your order, unless we tell you otherwise before shipping. Quotes we give you are valid for the period stated in the quote.
  • Some manufacturers set a minimum advertised price. Where that applies, the price shown on a page may differ from the price you pay at checkout.
  • Some products are restricted by law or by the manufacturer. We may ask for information to complete an order and may decline or cancel an order that we cannot lawfully or reasonably fill.
  • Product images are for illustration; the product you receive may differ slightly in packaging or appearance.

5. Orders and payment

Placing an order is an offer to buy. We accept it when we send a shipment notice, and we may decline or limit any order before then. You agree to pay for your order with a valid payment method and to give us correct billing details. Card payments are handled by our payment providers; we do not store full card numbers on the Site. Sales tax is added where required by law.

6. Shipping

Shipping charges and estimated delivery times are shown at checkout and are estimates, not guarantees. Because many items ship from the manufacturer or a distributor, one order may arrive in more than one shipment. Risk of loss passes to you when the carrier delivers the order to the address you gave us. Please inspect packages on arrival and contact us promptly about damage or missing items.

7. Returns, refunds and cancellations

Our Returns & Refunds page is part of these Terms. In short: orders can be canceled until they ship; many medical products cannot be returned once opened or shipped; returns need a Return Merchandise Authorization (RMA) number from us first; and returns must be arranged within 10 days of delivery.

8. Accounts, quotes and company accounts

We may suspend or close an account that is used in violation of these Terms, shows signs of fraud, or has unpaid balances. Company or facility accounts and negotiated pricing are subject to any written terms we agree with you, and those terms control if they conflict with these Terms.

9. Messages and social media

If you give us your phone number or email address, you agree that we may contact you about your orders and your requests. Marketing messages are sent only as described in our Privacy Policy, and you can opt out at any time by following the instructions in the message. Our content on social media platforms is subject to those platforms' own terms.

10. Our content and your content

The Site and its text, graphics, videos, logos and software are owned by Great Oak Medical or its licensors and are protected by law. You may view and print pages for your own personal or business purchasing use. You may not copy, republish or sell our content without our written permission. If you send us a review, comment or other content, you give us a non-exclusive, royalty-free right to use, display and reproduce it in connection with our business, and you confirm that you have the right to do so.

11. Third-party links and services

The Site may link to websites and services we do not control. We are not responsible for their content, products or privacy practices.

12. Disclaimers

The Site and the information on it are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties not expressly stated in these Terms, including implied warranties of merchantability and fitness for a particular purpose. Products are covered by the manufacturer's warranty, if any, and we pass along manufacturer warranty information on request. Nothing in these Terms limits any warranty or right that the law does not allow to be limited.

13. Limit of liability

To the fullest extent permitted by law, Great Oak Medical and its officers, employees and suppliers are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, arising from your use of the Site or from products purchased. Our total liability for any claim relating to an order is limited to the amount you paid for that order. Some jurisdictions do not allow certain limits, so some of this may not apply to you.

14. Changes to these Terms

We may update these Terms from time to time. The "Effective" date at the top shows when they last changed. Orders are governed by the Terms in effect when you placed them. Continuing to use the Site after a change means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute that we cannot resolve informally will be brought in the state or federal courts located in Santa Clara County, California, and you and we consent to those courts.
